بغداد (بابنيوز) : أعلن وزير الدولة الناطق الرسمي باسم الحكومة العراقية علي الدباغ بأن مجلس الوزراء قرر BAGHDAD (Babuz): Minister of State and government spokesman Ali al-Dabbagh that the Council of Ministers decided to الموافقة على مشروع قانون التوقيع الالكتروني والمُعاملات الالكترونية المُدقق من قِبل مجلس شورى الدولة وإحالته الى مجلس النواب إستناداً الى أحكام المادتين (61/البند أولاً و80/البند ثانياً) من الدستور مع الأخذ بنظر الاعتبار رأي اللجنة القانونية في الأمانة العامة لمجلس الوزراء والملاحظات المطروحة من قبل السادة الوزراء ومجلس شورى الدولة. وأشار الدباغ الى أن الموافقة على مشروع قانون التوقيع الالكتروني والمُعاملات الالكترونية تأتي إنسجاماً مع التطور الحاصل الذي يشهده النهوض المؤسساتي للبلد بإعتماد التكنولوجيا الحديثة في الأعمال اليومية والإرتقاء بمستوى الأداء للدوائر العامة والتعاملات بين الدوائر الحكومية وتسهيل بعض الأمور التي تذلل الصعوبات الإدارية وتختصر الزمن في إنجاز المعاملات بشكل كفوء وضمن إطار قانوني للمعاملات الالكترونية من خلال وسائل الإتصالات الحديثة وتشجيع إستخدام الإنترنت وتكنولوجيا المعلومات وتنميتها وتنظيم خدمات التوقيع الالكتروني والمعاملات الالكترونية ومواكبة التطورات القانونية فيه وتطويع النظام القانوني التقليدي بما ينسجم مع نظم تقنية المعلومات والإتصالات الحديثة حيث يهدف مشروع القانون الى منح الحجة القانونية للمعاملات الالكترونية والتوقيع الالكتروني وتنظيم أحكامها بالإضافة الى تعزيز الثقة في صحة المعاملات الالكترونية وسلامتها. وأوضح الدباغ أن الأمانة العامة لمجلس الوزراء إقترحت مشروع القانون بالنظر للتطور الالكتروني ويعتمد مشروع القانون على عمل قانون نموذجي للتوقيع الإلكتروني والمعاملات الالكترونية والذي أعدته لجنة متخصصة تابعة للأمم المتحدة وقد تم الإطلاع على قوانين مشابهة في بعض الدول بهذا المجال كالقانون الأمريكي والانكليزي والإماراتي والأردني والفرنسي لتتم صياغته وفق متطلبات الحاجة للتقنية الالكترونية وقد أوضح مشروع القانون ما يقصد بالمعاملات الالكترونية وهي الطلبات والمستندات والمعاملات التي تتم بوسائل الكترونية كالأجهزة والمعدات والأدوات الكهربائية أو المغناطيسية أو الضوئية أو الكهرومغناطيسية أو أية وسائل مشابهة تستخدم في إنشاء المعلومات ومعالجتها وتبادلها وتخزينها وتسري أحكام القانون على المعاملات الالكترونية التي ينفذها الأشخاص الطبيعيون أو المعنويون وعلى المعاملات التي يتفق أطرافها على تنفيذها بوسائل الكترونية وكذلك الأوراق المالية والتجارية الالكترونية. وأضاف الدباغ أن أحكام هذا القانون لا تسري على المعاملات المتعلقة بمسائل الأحوال الشخصية والمواد الشخصية وإنشاء الوصية والوقف وتعديل إحكامهما والمعاملات المتعلقة بالتصرف بالأموال غير المنقولة والمعاملات التي رسم لها القانون شكلية معينة حيث يعد التوقيع الالكتروني صحيحاً وصادراً عن الموقع إذا توفرت وسائل لتحديث هوية الموقع والدلالة على موافقة لما ورد في المستند الالكتروني وحسب إتفاق ويأخذ التوقيع الالكتروني في نطاق المعاملات المدنية والتجارية والإدارية الصفة القانونية ذاتها المقررة للتوقيع الخطي إذا ما روعيت الشروط المذكورة آنفاً وتتولى الشركة والتي عرفها القانون بأنها الشركة العامة لخدمات الشبكة الدولية للمعلومات في وزارة الإتصالات منح تراخيص إصدار شهادات التصدير بعد إستحصال موافقة الوزير وتحديد المعايير الفنية لأنظمة التوقيع الالكتروني والمتابعة والإشراف على أداء الجهات العاملة في مجال إصدار شهادات التصديق وتقويم أدائها وتقديم المشورة الفنية للجهات العاملة في مجال التوقيع الالكتروني وتصديق الشهادات.
